What is an advance disposition?

An advance disposition is a legal document (not a will) in which a legally competent person designates someone to make decisions for them in the event that they become incapacitated. This includes personal, financial and legal matters.

Why should you have an advance directive?

To ensure that your personal wishes and needs are respected, if you become unable to make your own decisions. It allows you to appoint a trusted person to act on your behalf, avoiding legal uncertainties. Additionally, it protects you from state intervention (KESB). Spouses should also create an advance disposition, as legal spousal representation is not defined in marital law.

Advance Disposition Package

In your home or your business premises, we set up the necessary documents. My advance disposition package includes a handwritten document (in German or English) – which you write based on a template and I will review, the living will, and the general power of attorney.

When should I create an advance disposition?

The best time to create an advance directive is now, while you are still capable of making your own decisions. This ensures your wishes are documented and respected in case you become incapacitated.

What should you consider when creating an advance disposition?

Many people try to phrase their advance disposition by themselves – which is, of course, possible, but there is a very real danger that this way, faulty and/or legally invalid documents are prepared.

Unfortunately, time and again I see invalid documents which have been prepared alone and with much effort.

To illustrate, my client Elisabeth had prepared her advance disposition. However, when it came to signing the document, she made a rather amusing error. Instead of indicating the current year, she inadvertently wrote '1918'. Obviously, this was a simple mistake, but legally speaking, it could have been considered document falsification. As a result, Elisabeth had to rewrite that particular page. It's worth noting that neither of us were alive in 1918, making the situation even more humorous.

Why and for what reason?

Hans and Maria have been married for 45 years. Since marital law does not regulate legal representation in such cases, both of them created an advance disposition four years ago, appointing each other as their representative.

Diagnosis of dementia

Hans has since been diagnosed with dementia. Unfortunately, his condition has deteriorated to the point where Maria can no longer care for him alone. He has had to be placed in a nursing home. The mortgage on their home is up for renewal, and Maria has contacted the bank. The bank is requiring confirmation from the KESB that her husband is incapacitated.

Without this confirmation, she cannot adjust the mortgage or manage Hans’ bank accounts.

Who is now authorized to make decisions for Hans?

Maria has submitted the original advance disposition to the relevant KESB. Along with this, she must provide a debt collection record and a criminal record check. Additionally, Hans’ doctor needs to confirm his incapacity. Following a KESB visit to Hans at the nursing home, they issued a certified document. Maria is now Hans’ legal representative and can proceed with modifying the mortgage.

Without the advance disposition, Maria would have been completely powerless.
